Terms and Conditions
Last updated: 9 October 2026Effective date: 7 October 2026
These Terms and Conditions govern access to and use of Apex Study, a web-based educational platform offering independent study materials for Cambridge IGCSE Biology (0610), Chemistry (0620), and any other subjects later made available (the “Service”).
The Service is operated by Colomba Lira Feliú, Chilean tax identification number 20.665.477-5, acting as a sole trader under the commercial name “Apex Study”, with a business address in Santiago de Chile. Our contact email is colomba@apexstudy.net.
By purchasing a subscription, creating an account, authorising a student profile, or using the Service, you agree to these Terms. If you do not agree, you must not access or use the Service.
1. Who May Use The Service
The Service is designed for students aged 13 to 17.
A person under 18 may use the Service only through an account created and managed by their parent or legal guardian (“Adult Account Holder”).
The Adult Account Holder is the person who enters into the contract with Apex Study, purchases and manages the subscription, accepts these Terms and our Privacy Policy, and authorises the creation and use of each student profile.
By creating an account, the Adult Account Holder confirms that:
- they are at least 18 years old;
- the information they provide is complete and accurate;
- they are the parent, legal guardian, or otherwise legally authorised to act on behalf of each student whose profile they create;
- they consent to the student’s use of the Service and to the processing of the student’s personal data as described in our Privacy Policy; and
- they will supervise the student’s use of the Service where appropriate.
Students under 13 may not create or use a profile. If we reasonably believe that a profile belongs to a child under 13, we may suspend it and request age or parental-authority verification. If adequate verification is not provided, we may delete the profile and its associated personal data, subject to any legal retention obligations.
We may restrict access from countries where offering the Service would breach applicable law, sanctions, export restrictions, intellectual-property requirements, or local regulations.
2. Accounts And Student Profiles
One subscription permits one Adult Account Holder to create one student profile, for a student within the same household. The profile may be used on up to two devices. These limits apply unless a different plan is expressly offered at the time of purchase.
Each student profile may be protected by an optional personal identification number (“PIN”).
The Adult Account Holder is responsible for:
- keeping login credentials and PINs confidential;
- ensuring that account information remains accurate;
- all activity occurring through the account, except where caused by a security failure attributable to Apex Study;
- preventing access by people outside the authorized household;
- promptly notifying us of suspected unauthorized access.
Accounts, subscriptions and student profiles may not be sold, transferred, rented, shared with another household, or used by a school, tutoring company, study center, or other organization unless we have expressly authorized such use in writing.
We may request reasonable information to verify account ownership, age, parental authority, payment status, or compliance with these Terms.
3. Free Content And Paid Subscriptions
A limited, predefined chapter or selection of content may be available free of charge so that users can evaluate the Service before purchasing.
Access to all other available chapters, quizzes, flashcards, structured questions, progress features and AI tutor functions requires a paid subscription, unless expressly stated otherwise.
The features included in each subscription, its duration, total price, currency, applicable taxes, billing frequency and renewal conditions will be displayed before the Adult Account Holder completes the purchase.
The subscription begins when payment is successfully confirmed and continues for the period shown at checkout.
Payments are processed by Paddle, which acts as Merchant of Record for the transaction. Paddle may collect payment and billing information, issue invoices or receipts, calculate applicable taxes, and process refunds on our behalf. Paddle’s own terms and privacy notice may also apply to the payment transaction.
Apex Study does not receive or store complete payment-card details.
4. Automatic Renewal
Unless clearly stated otherwise at checkout, paid subscriptions renew automatically for successive periods of the same duration.
The payment method associated with the subscription will be charged the applicable renewal price on the renewal date unless the Adult Account Holder cancels before that date.
We or Paddle will provide notice of an upcoming annual renewal by email within a reasonable period before the renewal date.
If the subscription price will increase, the Adult Account Holder will be informed before renewal. The new price will apply only to the next subscription period and not retroactively.
The Adult Account Holder may cancel automatic renewal at any time by contacting colomba@apexstudy.net.
Cancellation stops future renewals but ordinarily allows continued access until the end of the period already paid for. Cancellation does not automatically create a right to a refund, except as provided in our Refund and Cancellation Policy or required by applicable law.
If a renewal payment fails, we or Paddle may make further reasonable attempts to process it and may temporarily suspend paid access. We will not charge more than the price disclosed for the relevant renewal.
5. Right Of Withdrawal And Refunds
Refunds, cancellation rights and statutory withdrawal rights are governed by our Refund and Cancellation Policy, which forms part of these Terms.
Nothing in these Terms limits any mandatory right available to a consumer under the laws applicable in their country of residence.
Where applicable law requires the consumer’s express request or consent for digital services or content to begin during a statutory withdrawal period, that request or consent will be obtained separately during checkout.
6. Licence To Use The Service
Subject to payment and compliance with these Terms, Apex Study grants each authorized user a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable license to access and use the Service for private, non-commercial study.
This license does not transfer ownership of any part of the Service or its content.
The license ends when the subscription expires or is terminated, except for free content that we continue to make publicly available.
7. Prohibited Use
Users must not:
- copy, reproduce, record, photograph, scrape, download, republish, distribute, publicly display, translate, adapt, sell, license or commercially exploit Service content except where we expressly provide a download function or applicable law permits the activity;
- share an account or profile with anyone outside the authorized household;
- create accounts or profiles using false information or impersonate another person;
- use automated systems, bots, crawlers, scripts or data-extraction tools to access the Service;
- reverse engineer, decompile, probe or attempt to discover the source code or underlying structure of the Service, except where such restriction is prohibited by law;
- bypass usage limits, access controls, subscription restrictions or security measures;
- interfere with the operation, performance or security of the Service;
- introduce malware, harmful code or unlawful material;
- use the Service or AI tutor to generate, submit or distribute unlawful, abusive, threatening, discriminatory, sexually explicit or otherwise harmful content;
- enter another person’s personal, sensitive, confidential or proprietary information into the AI tutor without legal authority;
- use the Service to train, test or develop another artificial-intelligence system or competing educational product without our prior written permission; or
- use the Service in violation of applicable law or another person’s rights.
8. Educational Content And Intellectual Property
The Service and its original content—including original summaries, explanations, flashcards, quizzes, structured questions, design, organization, software, branding and graphics—are owned by or lawfully licensed to Apex Study and are protected by applicable intellectual-property laws.
Third-party names, trademarks, syllabuses and other protected materials remain the property of their respective owners.
“Cambridge”, “Cambridge IGCSE” and related names and marks are trademarks or protected identifiers belonging to Cambridge University Press & Assessment and/or their respective owners.
Apex Study is an independent educational resource. It is not affiliated with, authorized, endorsed, approved, certified or sponsored by Cambridge University Press & Assessment, Cambridge International Education, or any examination board.
References to examinations, syllabus codes and third-party trademarks are used solely to identify the examinations for which Apex Study provides independent study support.
Users should consult the relevant examination board’s current official syllabus, notices and authorized materials. Syllabuses, assessment rules and examination requirements may change.
9. AI Tutor
The AI tutor is an automated educational support tool. It is not a human teacher, examiner, counsellor or official representative of any examination board.
The AI tutor is intended to answer questions relating to the Biology and Chemistry materials available on the Service, subject to applicable usage limits.
Artificial-intelligence systems may produce information that is incomplete, outdated, misleading, biased or incorrect. Users must independently verify important answers against the current official syllabus, trusted educational sources, or a qualified teacher.
AI tutor responses must not be treated as official marking guidance, predicted examination content, or a guarantee of the marks an examiner will award.
Users must not enter full names, addresses, passwords, payment information, health information, school records, photographs, confidential documents or other unnecessary personal or sensitive information into the AI tutor.
Information about how AI tutor conversations are processed, stored and shared appears in our Privacy Policy.
We may apply reasonable safety filters, usage limits and monitoring measures to prevent abuse and protect users. No automated safety system can guarantee that every unsuitable response will be prevented.
A concerning, harmful or clearly incorrect response may be reported to colomba@apexstudy.net.
10. No Guarantee Of Examination Results
We aim to provide useful, accurate and syllabus-relevant study support. However, we do not guarantee:
- any particular examination grade, score or academic outcome;
- that every official syllabus topic will always be available;
- that Service content will predict actual examination questions;
- that all content will be entirely free from errors; or
- that use of the Service alone will be sufficient examination preparation.
Results depend on multiple factors outside our control, including the student’s effort, understanding, examination performance, school instruction, official syllabus changes and assessment decisions made by the relevant examination board.
If a user identifies a possible content error, they should notify us so that we can investigate and, where appropriate, correct it.
11. Availability And Changes To The Service
We aim to keep the Service reasonably available but do not guarantee uninterrupted, error-free or continuous access.
Access may be interrupted by maintenance, upgrades, security incidents, internet failures, provider outages, events beyond our reasonable control, or measures necessary to protect users and the Service.
We may make reasonable changes to content, functions, design and technical requirements to maintain, secure or improve the Service or comply with law.
We will not intentionally remove a core paid feature during an active subscription period without reasonable justification. If we permanently discontinue the Service or materially reduce its essential paid functionality, we may provide an appropriate remedy, which may include continued access for a transitional period, an alternative service, account credit, or a proportionate refund.
12. User Support
Support requests may be submitted to colomba@apexstudy.net.
Users should provide sufficient information for us to identify the account and understand the issue, but should not send passwords, complete payment-card information or unnecessary sensitive data.
We aim to acknowledge support and complaint requests within five business days. Complex matters may require additional time.
13. Suspension And Termination By Apex Study
We may restrict or suspend access where we reasonably believe that:
- these Terms have been breached;
- an account is being used fraudulently or without authorization;
- continued access presents a security, legal or safety risk;
- payment is overdue or has been reversed;
- the user is under the permitted age; or
- suspension is required by law or a competent authority.
Where appropriate, we will explain the reason and allow a reasonable opportunity to remedy the issue.
We may terminate an account for a serious breach, repeated breaches, fraud, deliberate security interference, unlawful use, infringement of intellectual-property rights, or conduct that creates material risk to Apex Study or other users.
Termination for the user’s material breach does not automatically entitle the Adult Account Holder to a refund.
Nothing in this section affects mandatory consumer rights.
14. Account Closure By The User
The Adult Account Holder may request closure of the account by contacting colomba@apexstudy.net.
Closing an account and cancelling a subscription are separate actions. The Adult Account Holder should cancel automatic renewal before closing the account.
Personal data will be deleted or anonymized as described in our Privacy Policy, subject to legal retention obligations.
15. Third-Party Services And Links
The Service relies on third-party providers for hosting, databases, payment processing and artificial-intelligence functions.
We select and manage providers using reasonable care, but we do not control independent third-party websites or services.
Third-party links are provided for convenience and do not imply endorsement. Users should review the applicable third party’s terms and privacy information.
16. Limitation Of Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from fraud, wilful misconduct, gross negligence where applicable, death or personal injury caused by negligence, or breach of mandatory consumer or data-protection rights.
Subject to section 16.1 and to the fullest extent permitted by law, Apex Study will not be liable for indirect, incidental, special or consequential losses that were not reasonably foreseeable when the contract was made.
Apex Study is not responsible for examination-board decisions, syllabus changes, grading decisions, school performance, internet connectivity, user devices, or unauthorized use caused by the user’s failure to protect account credentials.
Where liability may lawfully be limited, Apex Study’s aggregate liability arising from the Service during a subscription period will not exceed the amount paid for that subscription period. This limitation does not apply where prohibited by mandatory law.
These Terms do not reduce any legal remedy available to a consumer for a Service that does not conform to the contract or to mandatory standards.
17. Indemnity For Business Or Unauthorised Use
If a person uses the Service for commercial, institutional, unlawful or unauthorized purposes, they will be responsible, to the extent permitted by law, for losses and reasonable costs directly resulting from that use. This section does not apply to ordinary personal use by a consumer.
18. Events Beyond Reasonable Control
We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including widespread internet outages, natural disasters, war, civil disturbance, government action, labour disruption, cyberattacks despite reasonable safeguards, or major failures of essential third-party infrastructure.
This section does not remove any mandatory right to a refund or other remedy.
19. Changes To These Terms
We may update these Terms to reflect legal, security, technical or operational changes.
The current version and its update date will remain available through the Service.
We will notify Adult Account Holders by email or through the Service before a material change affects an active paid subscription.
A material change that disadvantages an existing subscriber will not apply retroactively unless required by law or necessary to address an urgent security risk.
If an Adult Account Holder does not agree to a material change, they may cancel future renewal. Any additional remedy required by applicable law will remain available.
20. Communications
Service, security, billing and legal communications may be sent to the Adult Account Holder’s registered email address.
Marketing communications will be sent only where legally permitted. Recipients may unsubscribe from marketing at any time without affecting essential service communications.
21. Complaints
Complaints may be submitted to colomba@apexstudy.net.
The complaint should identify the account email, describe the issue and state the requested resolution.
We will review complaints fairly and aim to provide a substantive response within ten business days.
Consumers retain the right to contact the consumer-protection authority or competent court available under applicable law.
22. Governing Law And Jurisdiction
These Terms are governed by the laws of Chile.
If the Adult Account Holder is a consumer, this choice does not deprive them of mandatory protections available under the laws of their country of habitual residence.
Any dispute may be brought before the courts or competent consumer authority determined by applicable mandatory law.
23. General Provisions
If any provision is found invalid or unenforceable, the remaining provisions will continue in effect. The affected provision will be interpreted or adjusted only to the minimum extent necessary to make it lawful.
A failure to enforce a provision immediately does not waive the right to enforce it later.
These Terms, the Privacy Policy, the Refund and Cancellation Policy and the information shown at checkout form the agreement between the Adult Account Holder and Apex Study regarding the Service.
If information shown at checkout grants the consumer more favourable rights than these Terms, the checkout information will apply to that purchase.
These Terms are available in English. If translated, the English version prevails, subject always to mandatory consumer law.
